Official Rules

Silicon Valley IoT & Blockchain Virtual Hackathon - Official Rules and Code of Conduct

  1. Sponsors:
  2. The Silicon Valley IoT & Blockchain Virtual Hackathon (“Hackathon”) is sponsored by TIBCO Software Inc., 3303 Hillview Avenue, Palo Alto, CA 94304 (“Sponsor”). The Hackathon will have other sponsors with their own challenges.

  3. Timing:
  4. The Hackathon will be hosted from 10:00 am (PDT) June 8, 2020 to 4:00 pm (PDT) on June 26, 2020, at https://www.hackerearth.com/challenges/hackathon/tibco-hackathon/ (“Hackathon Site”).

  5. Eligibility:
  6. The Hackathon is open to all individuals who are at least eighteen (18) years old at the time of entry and who legally reside in the United States. Employees, independent contractors, officers, and directors of Sponsor, their affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, the judging panel, and the immediate family members and persons living in the same household of such persons, are not eligible to participate in the Hackathon. By participating in the Hackathon, you agree to be bound by these Official Rules. All national, provincial, regional, municipal, and local laws and regulations apply. It is your responsibility to ensure that you are legally eligible to enter the Hackathon and receive a Prize under any laws applicable to you in your jurisdiction of residence or otherwise. Any individual not meeting the Eligibility requirement will be automatically disqualified.

  7. How to Enter:
  8. You must register for the Hackathon by completing a registration form at https://www.hackerearth.com/challenges/hackathon/tibco-hackathon/ . All registration forms must be completed in its entirety. You will receive an e-mail confirmation registering you for the Hackathon (“Participant”). You, as an individual or as part of the team (comprising of no more than five (5) individuals) (“Team”), will build a software application in accordance with the directions on the Hackathon Site. Each Team will submit a two (2) to three (3) minute video (demonstrating the Software Application) to the Hackathon Site by June 26, 2020 (“Entry”). All Entries must be received no later than 4:00pm (PDT) on June 26, 2020. Only one Entry per Team is allowed. All Entries must comply with the Entry Requirement set forth below.

  9. Entry Requirements:
  10. By submitting an Entry, each Participant warrants and represents that the Entry (including but not limited to source code, object code, artwork, and all visual and auditory components):

    • is your team’s original work;
    • has not been previously published, sold, or submitted in any other competition, hackathon, promotion, or contest;
    • does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity;
    • does not contain any information considered to be confidential by any person or entity; and
    • was not developed in any substantive form prior to the Hackathon, although ideation, research and material gatherings are permitted. Participant further agree that Participant’s Entry complies with the licenses controlling any third party components that are included in the Entry (e.g., components that you did not write) and that any such third party components are subject to licenses (if any) that allow for free, unlimited use and distribution, and modification without restriction, and furthermore may not include licenses (including but not limited to the GNU General Public License) which require mandatory reciprocal contribution of modifications to the code. Any Entry not complying with the above entry requirements will not be eligible for any prize.
  11. Judging:
  12. The Entries will be judged by an independent panel of judges selected by Sponsor at its sole discretion (“Panel”). The Entries shall be judged based on originality, creativity, technical complexity, user experience, and business potential as set forth below:

    • Business feasibility: Does the Entry have real business potential?
    • Creativity: Is the Entry new and innovative?
    • Completeness: Does the Entry work “end-to-end”?
    • Clarity of Message: Does the team articulate the Entry clearly and succinctly?

    The Panel’s decisions are final and binding. Entries must be virus-free. Entries that contain any content that is pornographic in nature, lewd, or sexually explicit, in Sponsor’s sole discretion, will be disqualified. Any non-conforming Entries will be disqualified.

  13. Prizes:
  14. The prize for the winning Entry (“Prize’) are as follows:

    • First Place Winner- Amazon Gift card in the amount of Two Thousand Five Hundred Dollars ($2,500)
    • Second Place Winner- Amazon Gift Card in the amount of One Thousand Dollars ($1,000)
    • Third Place Winner- Amazon Gift Card in the amount of Five Hundred Dollars ($500)

    Sponsor may substitute prizes in their sole discretion. Prizes are non-assignable/non- transferable. Sponsor reserves the right to withhold applicable taxes, but payment of all applicable taxes are the sole responsibility of each winner. You may be required to provide proof of eligibility prior to award of Prize.

  15. Winner Notification:
  16. The winning Entry will be posted at 4:00 pm (PDT) on June 30. 2020, at https://www.hackerearth.com/challenges/hackathon/tibco-hackathon/ . If the team with the winning Entry (“Winner”) is ineligible, fails to claim prize or fails to comply with any term or condition of these Official Rules, prize may be forfeited and an alternate winner selected in accordance with these Official Rules. Winners will be required to sign and return a declaration of eligibility, and, where lawful, a publicity consent agreement as a condition of receiving the prize. If a selected winner fails to return in a timely manner the completed and executed declaration and consent as required, prize may be forfeited and an alternate winner selected.

  17. General Terms and Conditions:
  18. Sponsor is not responsible for and shall not be liable for: (a) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind (b) failed, incomplete, partial, garbled, or delayed computer transmissions; (c) any condition caused by events beyond the control of Sponsor that may cause the Hackathon to be disrupted or corrupted; (d) any injuries, losses, or damages of any kind arising in connection with or as a result of a prize, or acceptance, possession, or use of a prize, or from participation in the Hackathon; (e) any printing or typographical errors in any materials associated with the Hackathon; (f) any regional, state, provincial or local laws or regulations violated during the creation of the entries by the participant(s). Sponsor reserve the right to suspend, cancel, or modify the Hackathon if fraud or technical failure corrupts the administration, security, or proper play of the Hackathon, as determined by Sponsor in its sole discretion. Sponsor reserves the right to modify the Official Rules and to modify or terminate the Hackathon in its entirety at any time and at Sponsor’ sole discretion. Should the Official Rules be modified or the Hackathon be modified or terminated prior to the stated end date, notice will posted at the Hackathon Site. Each Participant agrees to release and hold Sponsor harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Hackathon or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, property damage, and claims based upon intellectual property infringement, publicity rights, defamation, or invasion of privacy. Each Participant agrees that Sponsor’s only obligation is to judges the Entries according to the procedures and criteria set forth in these Official Rules, and award the prizes set forth herein only to eligible winners, subject to the terms and conditions herein. Each Participant agrees that Sponsor’s obligation is fair and adequate consideration for any entry submitted, and that Participant is not entitled to and shall not seek any further compensation. Each Participant acknowledges and consents to Sponsor’s or third parties (on behalf of Sponsor) taking photos or make recordings, including but not limited to audio, video, and/or photographic recordings (“Images”) of the Entries. Sponsor may, at its sole discretion, edit, mix, and/or transfer in whole or in part, any such Images to productions (“Productions) for advertising and promotional purposes. Each Participant gives his or her consent for Sponsor to use and reproduce Participant’s name, likeness and/or image without additional compensation in any medium, now known or hereafter devised, for advertising and promotional purposes worldwide in perpetuity, except as prohibited by law. Each Participant furthermore agrees that, by submitting an Entry, he or she allows Sponsor to use the registration contact information for emailing newsletters and promotional material. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Participant and Sponsor in connection with the Hackathon, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.

  19. Code of Conduct:
  20. Sponsor expects all participants of the Hackathon to help make the Hackathon a place that welcomes and respects all participants, regardless of race, gender, age, sexual orientation, disability, physical appearance, ethnicity, or religion. Sponsor is committed to providing a harassment-free experience for everyone and will not tolerate any form of harassment or discrimination. Forms of harassment include, but are not limited to, offensive verbal comments related to race, ethnicity, gender, religion, sexual orientation, socioeconomic status; sexist, racist, and exclusionary jokes; and acts that insult or belittle other participants in any way. If any participant engages in behaviors which are harassing or discriminatory in any way, Sponsor will take all actions it deems appropriate in order to provide a safe and secure environment for all participants.
